Demolition permits must be obtained from the Municipal Building Official prior to the demolition of any existing building or structure. This permit is separate from that required for construction, alteration or renovations of existing buildings.
Please note that receipt of a UCC demolition permit does not relieve the permit holder of compliance responsibilities under other state or federal laws and regulations, including but not limited to: asbestos remediation, advanced notification to the PA Department of Environmental Protection and the US Environmental Protection Agency of demolition work, historic preservation and the capping of any sewer and water connections.
Also, please be aware of the regulations concerning the proper disposal of demolition wastes. The Pennsylvania Department of Environmental Protection (DEP) regulates demolition and renovation operations under the National Emission Standard (“NESHAP”) for asbestos. Nearly all demolition projects, regardless of the presence of asbestos, require a ten (10) day advanced notification to the DEP and the U.S. Environmental Protection Agency. This requirement applies to all public, institutional, commercial and industrial structures and individual residential buildings having more than four (4) dwelling units, and any group of two (2) or more residential dwellings under common control. These regulations impose extensive measures for control of emissions during demolition operations and subsequent waste removal.
